Building Disputes

Our Principal Surveyor, Don Waterworth, is also a leading Expert Witness on all building matters. Don also acts as Expert Advisor to Channel 5 on their programme ‘Cowboy Builders’.

When a consumer falls foul of a dodgy builder / tradesman it can be a ‘nightmare’ for the consumer, and can cost the consumer thousands of pounds and an endless number of sleepless nights. Should you find yourself in the unfortunate position, then you need the help, advice and guidance provided by a Surveying Professional  who has over 25 years of experience and has worked on over 2,500 disputes and Court cases (and been successful in assisting a successful consumer outcome in over 90% of the disputes).

Don Waterworth is such a Professional.

It is important that should you find yourself in a dispute with your builder / tradesman, that you seek Expert advice as soon as possible. It is often unwise to attempt to reason with, or indeed negotiate with an incompetent or arrogant builder / tradesman.

Additionally you need to consider your financial position if a dispute arises. It is reasonable that a builder / tradesperson be paid for the acceptable work they have completed. It is not reasonable, nor wise to pay a builder / tradesman in advance or indeed more than he has earned.

In our experience, many consumers feel pressured to pay and find themselves having paid the ‘bulk’ if not ‘all’ of the money due on the contract, even though the work is incomplete or unsatisfactory.

An initial telephone call to Hanley Amos Stewart is FREE and you will be given Professional and impartial advice. We would strongly advise that you do not attempt to resolve a dispute yourself, as things can quickly go wrong and the consequences and costs can be horrific.

Expert Witness Reports

I have 25 years of experience of Building Disputes, and have acted as an Expert Witness on over 2000 disputed matters, from the Supreme Courts of Justice, London, to local small claims courts and mediation.

In my opinion an Expert should be able to understand the vagaries of litigation, and also the requirements of the Civil Procedure Rules.

Expert evidence is a vital part of any case, and the contents of the Experts Report should not only be unambiguous, unbiased and technically correct, but should provide a clear and concise piece of information to the instructing Solicitor, thereby enabling the Solicitor to quickly assess the merits of a case during the pre-action protocol period, or indeed at any stage in the process.

“I have instructed Don Waterworth in Expert Witness work for several years. He is thorough, effective, and he has an amazing ability to comfort truly frazzled clients. His reports are concise yet detailed and to the point, and he is a convincing witness at mediations and in Court. You would want him on your side, and not on the other”.
John Brooke - Senior Consultant, Clyde & Co

“Don Waterworth provides a highly professional service delivered with great thought and care. Advice is always given honestly, in detail and with the best interests of the client at heart”.
Fiona Debney - Partner, Clarke Willmott

“If you are looking for an Expert in proceedings, Don can deliver you an Expert Report.” However Don’s strength lies in his ablility to see the bigger picture and his desire to find solutions to disputes rather than simply going through the motions of property surveys and reports”.
